§ 6.20.040. Impounded animal—Sale and disposition of proceeds.

  • If the animals impounded pursuant to this chapter are not redeemed within the time prescribed in the notice provided for in Section 6.20.030, then it shall be the duty of the animal control officer to offer for sale and sell the same to the highest bidder for cash, and out of the proceeds of such sale, pay, first, all fees, costs and expenses of the taking up, advertising, keeping and sale of such animal, second, the remainder, if any, to the city treasurer for the use of the owner of such animal. The city shall in no case be liable to or pay the owner any sum in excess of the sum so received by its treasurer as proceeds from the sale of any such animal, and in no case shall the city be liable for any fees or expenses of the city animal control officer for the taking, detention, advertising or sale, of any such animals.
