§ 2.12.030. Powers and authority.

    The city attorney is authorized and empowered to make and execute any bond, affidavit or other instrument in the name of the city, that may be necessary in any action, suit or proceeding in which the city may be a party, signing the same as city attorney.

    B.

    He shall have the power and authority to file and swear to complaints in the municipal court, upon information against any and all violators of city law, when, in his judgment, convictions therein can be secured; and complaints so made and sworn to upon information shall be of the same force and validity as if made and sworn to from personal knowledge. He shall likewise have the power and authority to "nolle prosequi" and cause to be dismissed, in either the municipal or district courts, unjust, vexatious and unwarranted prosecutions to which the city is a party.
