§ 2.44.050. Powers and duties—Street vacations.

    In addition to those powers granted by Section 2.44.040, the planning-zoning commission is empowered to hear and investigate all applications for vacation of streets, alleys or other public ways within the corporate limits of the city. All applications for such vacations are directed to the planning-zoning commission for its study and recommendation.

    B.

    The planning-zoning commission is directed to conduct a public hearing on each such application for vacation, and the date, time and place of each such public hearing shall be advertised in a newspaper of general circulation within the city at least ten days before the time set for such hearing. Personal notice of such hearing shall be given at least ten days before the date of such hearing by mail to the persons owning property within three hundred feet of the street, alley or other public way to which the application to vacate relates, and a special written notice shall also be given to all the utility companies operating in the public way under franchise granted by the city commission. At such hearing the planning-zoning commission shall hear all interested parties and shall thereafter submit in writing a recommendation to the city commission concerning such application for vacation. No vacation shall be accomplished except by ordinance passed by the city commission.

    C.

    The planning-zoning commission is authorized to adopt such rules and regulations relating to the powers conferred upon it by this section as may be deemed necessary.
