§ 18.10.400. Jurisdiction and application of regulations.

    The provisions of this title are applicable to lands in the city and that portion of the city extraterritorial planning and platting jurisdiction within one mile of the city limits of the city; however, for purposes of this section only, the area within one mile radius surrounding Ned Houk Park and the extension of Norris Street to Ned Houk Park shall be governed by subsection B of this section.

    B.

    For purposes of exercising the extraterritorial planning and platting jurisdiction of the city, the city will implement and apply, and hereby adopts by reference, the platting and subdivision regulations of Curry County as adopted by county Ordinance 97-3, as it now reads or as it may be amended or substituted in the future, as the subdivision standards to be applied within all areas of the city's extraterritorial planning and platting jurisdiction not included within the scope of Title XVIII in subsection A of this section.

    C.

    Notwithstanding any of the provisions of subsections A and B of this section, approval of all subdivision applications within the five miles extra-territorial planning and platting jurisdiction of the city will usually require the road rights-of-way be made a part of the subdivision plat, to-wit:

    1.

    Roadways on a section line shall have one hundred feet of total right-of-way, fifty feet preferably on either side of the section line;

    2.

    Roadways on the half section line shall have eighty feet of total right-of-way, forty feet preferable on either side of the section line;

    3.

    Ordinarily, capsulation shall be from the center of the section line or half section line.
