§ 17.80.220. Conversion to a lesser use.

    Uses may convert to a lesser intensity use upon receiving a conditional use permit or certification from the zoning officer that the new use is a lesser intensity, whichever is applicable.

    B.

    No enlargement of the use shall be permitted with the conversion, except as it qualifies under Sections 17.80.211-17.80.212. Provided the enlargement meets all this section's requirements, an enlargement is considered desirable if it promotes a neighborhood or community improvement.

    C.

    The following rules shall apply to determining whether a conversion promotes an improvement. At least three (including the one standard required) of the six following standards shall be met:

    1.

    Required. The first priority for land resulting from reductions in parking, loading area or exterior storage shall be to meet the maximum feasible landscaping provisions set forth by this title for the district in which the proposed conversion is located.

    2.

    The use's total amount of required parking shall be reduced as a result of the conversion.

    3.

    The use's total amount of peak hour and average daily traffic generated shall be reduced as a result of the conversion.

    4.

    Where noise generated on the nonconforming use's site is audible off site, the conversion shall reduce the noise level at least fifty percent.

    5.

    If exterior storage is involved, the conversion shall eliminate it.

    6.

    As a result of the conversion, truck traffic shall be reduced or eliminated.
