§ 17.160.050. Exclusions.

  • Every wireless telecommunications facility located within the city limits, whether upon private or public lands, shall be subject to this section except the following facilities, which shall be exempted:

    A.

    Any existing tower and antenna provided a building permit was issued for the tower or antenna prior to adoption of the ordinance codified in this section;

    B.

    Wireless telecommunications facilities used exclusively for emergency services including police, fire and operation of the city utilities; and

    C.

    Amateur radio towers and antennas below one hundred feet from ground level.

    1.

    Any person who desires to erect an amateur radio tower and antenna more than one hundred feet from ground level but less than two hundred feet from ground level may apply to the planning-zoning commission for exemption.

    2.

    The planning-zoning commission shall consider the application for exemption and make a recommendation to the city commission.
