§ 15.04.010. Findings and purpose.

  • Section 3-18-6, NMSA 1978 authorizes municipalities to prescribe certain building and construction standards within its planning and platting jurisdiction, and to issue permits pertaining to buildings.

    A.

    Section 3-17-6, NMSA 1978 authorizes municipalities to adopt by ordinance the conditions, provisions, limitations and terms of any codes so long as the codes provide for minimum requirements at least equal to the state requirements on the same subject.

    B.

    An ordinance adopting such code need only refer to the proper title and date of the code only, without setting forth the codes, conditions, provisions, limitations and terms and may include any exception or deletion to the code by setting forth the exception or deletion.

    C.

    It is in the best interests of the public for the city to adopt uniform standards for building and construction, exercising the full authority granted by the New Mexico Constitution and the laws and statutes of the state of New Mexico.
